These Terms of Service govern your use of spitohomeoffers.com and any request you submit through it. The site is operated by Castillo Holdings LLC, doing business as Spito Home Offers (“we,” “us,” “our”). By using the site you agree to these terms. If you do not agree, do not use the site.
1. What we are, and what we are not
We are a real estate investment company. We buy residential property directly, with our own funds, for our own account, generally to renovate and resell or to hold as a rental.
- We are not a licensed real estate brokerage and we do not represent you in a transaction. No agency relationship is created by using this site or by receiving an offer from us.
- We do not provide legal, tax, accounting, or financial advice. Selling a home has legal and tax consequences. Consult your own attorney and tax professional.
- We are not a lender and we do not offer loans, refinancing, or foreclosure rescue services.
- Because we are the buyer, our interests in a transaction are not the same as yours. You are entitled to your own representation, and we encourage it.
2. Offers are non-binding until signed
Any figure we provide — verbally, by text, by email, or in writing — is a non-binding preliminary offer. It is an invitation to negotiate, not a contract. No binding obligation exists on either side unless and until both parties sign a written purchase and sale agreement.
Any offer is expressly subject to:
- verification that you have the legal authority to sell the property;
- a clear and marketable title, confirmed by title search;
- verification of the property’s condition, which may include a walkthrough or inspection;
- the accuracy of the information you provided to us;
- disclosure and resolution of liens, judgments, unpaid taxes, and encumbrances.
If material facts differ from what was represented, we may revise or withdraw an offer before a purchase agreement is signed.
3. Information you provide
You agree that information you submit is accurate to the best of your knowledge, and that you either own the property or are legally authorized to act on behalf of the owner. Do not submit a property you have no authority over.
4. Consent to be contacted
By submitting your phone number you give us express written consent to contact you about your property and your offer, including by automated dialing, prerecorded message, and SMS text. Consent is not a condition of any purchase or sale. Message and data rates may apply. Reply STOP to opt out of texts. Full details are in our Privacy Policy.
5. No guarantee of an offer
Submitting the form does not entitle you to an offer. We decline properties for many reasons — location, condition, title problems, price expectations, or simply our current capacity. We will tell you if we cannot help, and where we can we will point you toward an alternative.
6. Assignment
We may assign a signed purchase agreement to an affiliated entity or partner investor. If we intend to do so, we will tell you before closing. Your right to the agreed purchase price is unaffected by an assignment.
7. Site content
Content on this site is provided for general information only and does not constitute an appraisal, a valuation, or professional advice about your specific property. Comparable sales and market statements are estimates. We make no warranty that the site will be uninterrupted, error-free, or current.
All text, design, and graphics on this site are our property or used with permission. You may not copy or republish them without written consent.
8. Testimonials
Testimonials reflect the experience of specific individuals and are not a guarantee of any result. Timelines, offer amounts, and outcomes vary with the property, its condition, the title situation, and market conditions.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of this site. Our total liability for any claim relating to the site is limited to one hundred dollars ($100). This limitation does not apply to obligations under a signed purchase agreement, which are governed by that agreement, and it does not limit any liability that cannot be limited under New Jersey law.
10. Governing law and disputes
These terms are governed by the laws of the State of New Jersey without regard to conflict of law principles. Any dispute arising from the site or these terms will be brought in the state or federal courts located in New Jersey, and you consent to that jurisdiction.
11. Changes
We may update these terms. The “Last updated” date reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance.
